1. Acceptance of Terms

By accessing or using the BlockbotX platform ("Service"), available at https://blockbotx.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and BlockbotX ("Company," "we," "us," or "our"). We reserve the right to update these Terms at any time, and your continued use of the Service following any changes constitutes your acceptance of the revised Terms.

2. Description of Service

BlockbotX is a Software-as-a-Service (SaaS) platform that provides automated cryptocurrency trading tools, including trading bots, portfolio management, and analytics. The Service connects to third-party cryptocurrency exchanges via user-provided API keys to execute trading strategies on the user's behalf.

BlockbotX does not custody, hold, or control user funds at any time. All trading activity occurs directly on the connected third-party exchange. BlockbotX does not facilitate fiat-to-cryptocurrency conversions or direct fund transfers between users.

3. Account Registration

To use the Service, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction.
• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials, including your password and any two-factor authentication methods.
• Promptly notify us of any unauthorized access to your account.

You are solely responsible for all activity that occurs under your account. BlockbotX is not liable for any loss or damage arising from unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Engage in market manipulation, wash trading, spoofing, or any other form of fraudulent or deceptive trading activity.
• Violate any applicable local, state, national, or international law or regulation.
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Service.
• Interfere with, disrupt, or create an undue burden on the Service or the networks connected to it.
• Use automated scripts, bots, or other tools to access the Service in a manner not expressly authorized by BlockbotX.
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service.

5. API Keys & Exchange Connections

To enable automated trading, you must provide API keys from your cryptocurrency exchange accounts. By connecting your exchange account, you acknowledge and agree that:

• You are solely responsible for managing API key permissions on your exchange. We strongly recommend enabling only trade permissions and never enabling withdrawal permissions.
• Your API keys are stored using AES-256-GCM encryption. While we employ industry-standard security measures, you accept the inherent risk of connecting third-party services to your exchange account.
• BlockbotX is not responsible for any actions taken by the exchange, including but not limited to account freezing, fund seizure, or changes to exchange API functionality.
• You are responsible for ensuring that your use of the Service complies with the terms of service of your connected exchange.

6. Subscription & Payments

BlockbotX offers paid subscription plans. By subscribing to a paid plan, you agree to the following:

• Payment Processing: All payments are processed securely through Stripe. BlockbotX does not directly store your credit card or payment information.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date.
• Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access until that date.
• Refund Policy: We do not provide refunds for partial billing periods. If you cancel mid-cycle, you will continue to have access to the Service until the end of the current billing period.
• Price Changes: We reserve the right to change subscription prices. You will be notified at least 30 days before any price change takes effect.

7. Disclaimer of Warranties

Please read this section carefully.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

BlockbotX does not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee any specific trading results, profits, or outcomes. The Service is a software tool and does not constitute financial, investment, tax, or legal advice. Any decisions you make based on the Service are made at your own risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, BlockbotX and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Trading losses, regardless of whether caused by bot malfunction, incorrect configuration, or market conditions.
• Losses resulting from exchange outages, API errors, or connectivity failures.
• Losses caused by market volatility, price fluctuations, or liquidity issues.
• Unauthorized access to your account or exchange connections.
• Any interruption or cessation of the Service.

In no event shall BlockbotX's total aggregate liability exceed the amount you have paid to BlockbotX in the twelve (12) months preceding the event giving rise to the claim.

9. Account Suspension & Termination

BlockbotX reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine in our sole discretion violates these Terms or is harmful to the Service, other users, or third parties.

You may delete your account at any time through your account settings. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy. Any active subscriptions will be cancelled, and no refund will be provided for the remaining billing period.

10. Intellectual Property

All intellectual property rights in the Service, including but not limited to the software, algorithms, design, trademarks, logos, and content, are owned by BlockbotX or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of the Service, unless applicable law permits such activity notwithstanding this limitation.

11. Third-Party Services

The Service integrates with third-party services including, but not limited to, cryptocurrency exchanges (e.g., Binance) and payment processors (Stripe). These third-party services are governed by their own terms of service and privacy policies.

BlockbotX is not responsible for the availability, accuracy, or reliability of third-party services. Your use of third-party services through BlockbotX is at your own risk, and you agree to comply with the applicable terms of those services.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or by posting a prominent notice on the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. If you do not agree with any changes, you must discontinue use of the Service and delete your account.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.
